1. Acceptance of Terms
By using Topofthecringe, you agree to these Terms of Service. If you do not agree, please do not use the platform. These terms apply to all visitors, competitors, and voters.
2. Eligibility
The platform is open to anyone aged 18 or older. By entering, you confirm you are legally permitted to enter competitions and make payments in your jurisdiction.
3. Competition Entry
Each entry requires a $5 non-refundable fee paid via Stripe. Once your payment is confirmed and entry is live, no refunds will be issued. You are responsible for ensuring your video URL remains accessible throughout the competition.
4. Content Ownership
You retain ownership of your performance video. By submitting, you grant Topofthecringe a non-exclusive, royalty-free licence to display and promote your submission within the platform.
5. Prohibited Content
Entries containing explicit content, hate speech, copyright violations, or misrepresentation will be removed without refund. We reserve the right to disqualify entries at our discretion.
6. Voting
Votes are cast anonymously and are final. Attempts to manipulate votes through bots, VPNs, or other automated means will result in disqualification of the associated entry.
7. Prize Distribution
The winner is determined by vote count at competition close. The full prize pool is awarded to the winner. Topofthecringe takes no platform fee. Winners are contacted within 48 hours.
8. Limitation of Liability
Topofthecringe is not liable for technical failures, payment disputes handled by Stripe, or loss of access to video content hosted on third-party platforms.
9. Modifications
We may update these terms at any time. Continued use of the platform after changes constitutes acceptance of the revised terms.
10. Governing Law
These terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of courts in Victoria.
